This separation is dependent on her action alone. Get a restraining order and have him thrown out of the home or she has to leave. She is very confused and indecisive about what to do. Using the turned 5th doesn't make sense to me. His 5th represents his own children, it's assumed they are his own just by using that house. The question is about another's baby and whether it's his.
