Mercury not catching up with Mars in Scorpio

I'm a bit confused and hope someone'll help me...
This is a Horary cast for a friend of mine yesterday. I have Mercury in Scorpio for the querrent and Mars in Scorpio for the quesited. Looking at the ephemerides I see that when Mars is at 29 degs and fifity something, Mercury is still at 26 degrees. The conjunction means 'yes' to the answer. I think they're within orbs to be regarded as a conjunction. My question is: are the planets have to be in partile conjunction for the answer to be Yes?

Some would say that they have to reach a conjunction in the sign in which they are currently residing. However, the conjunction will still take place, but the circumstances of the querent will have changed; by the time Mercury reaches Mars, Mars will have lost its strength and Mercury will be in detriment, so even if it's a 'yes', it may not be a very *good* yes!

Thanks for your reply. So you wouldn't consider this conjunction? I was hoping that the 3 degrees orb is 'conjunciotion enough'

If they came to conjunction within the same sign, then, yes, but as they don't, I suspect it's 'no', or at best a 'qualified yes'. It also depends strongly on what the Moon is doing in the chart. Does it aspect the significators?

It is a little more complicated at present. As Mercury and Mars have already made a conjunction and separated when Mercury has gone retrograde.

You are right that they will not meet again in Scorpio but depending on the rest of the chart the conjunction that already happened may be re-activated positively ( translation/collection etc) and/or negatively ( frustration) by the other planets.

Interpretation of charts involving Mercury at present are very interesting and I would like to see some other views and/or examples.

I got confused because in natal Astrology, the three degree orb is considered to be conjunction. So in Horary, the aspect'll have to be partile(exact)? I thought there might be a possibility because they get quite close.
In this chart the Moon on the ASC is at 17 degrees in Virgo, already separated from the sextile to both Mercury(at 9 degrees) and to Mars(at 15 degrees). So there's no applying translation here.
